In France, the grenelle II law of July 12, 2010 regarding national commitment for the environment has subjected wind farms to the regime of Classed Installations for Environmental Protection (ICPE).

At the same time, this law made the commissioning of wind turbines subject to authorization dependent on the demonstration, by the operator, of its technical and financial capabilities. As for financial capacities, it is notably about the operator providing financial guarantees aimed at ensuring that the cost of decommissioning and restoration of the site in case of operator's failure will indeed be borne by the latter.

Technical and financial capacities are assessed by the administration and the judge based on "bundles of indications", which are just as many criteria that need to be understood and proven when drafting the note demonstrating the technical and financial capabilities.
